SÃO PAULO, SP (UOL/FOLHAPRESS) – A rede de joias Vivara foi condenada a pagar indenização de R$ 10.000 por impor padrões de gênero e de aparência durante os processos de contratação. A sentença foi dada pelo Tribunal do Trabalho de São Paulo e ainda cabe recurso.
O fundador da empresa exigia mulheres de cabelos longos e lisos, magras, sem tatuagem e sem piercing, segundo os autos. Uma analista de recrutamento e seleção, autora da ação trabalhista, afirmou que era obrigada a adotar critérios relacionados a padrões de beleza para escolher as contratadas.
A analista contou que as vagas deveriam ser preenchidas exclusivamente por mulheres. O motivo seria evitar que as funcionárias tivessem relacionamentos amorosos no trabalho e engravidassem.
A exclusividade feminina se aplicava somente a vagas de atendimento ao público. Para vagas administrativas, tanto homens quanto mulheres poderiam ser admitidos. Uma testemunha confirmou as orientações e disse que os critérios de contratação eram passados para a equipe apenas verbalmente.
A empresa objetificou o corpo feminino e exigiu padrões de beleza, segundo a juíza Yara Campos Souto. A magistrada considerou que “a atitude de só contratar mulheres pode parecer benéfica para o gênero em um primeiro olhar, mas no caso concreto revela comportamento machista e discriminatório”.
A empresa deve pagar R$ 10.000 à analista de recrutamento e seleção por danos morais. Para a juíza, ficou provado que a empresa impôs critérios discriminatórios e ilícitos à funcionária, o que caracteriza atentado a sua dignidade e integridade.
Ainda cabe recurso da decisão. A reportagem tenta contato com a Vivara para um posicionamento. O espaço segue aberto para manifestação.
