Cinco novos projetos de lei para regulamentar o transporte de animais de estimação por aeronaves foram apresentados na Câmara dos Deputados desde a última segunda-feira, 22, quando o cão Joca, um golden retriever de cinco anos, morreu durante um transporte aéreo realizado pela Gollog, serviço de cargas da companhia aérea Gol. Desde a morte do animal, Tabata Amaral (PSB-SP), Pedro Aihara (PRD-MG), Marcos Tavares (PDT-RJ), Camila Jara (PT-MS) e Denise Pessôa (PT-RS) apresentaram propostas de regulamentação. A pré-candidata à Prefeitura de São Paulo quer que as empresas sejam obrigadas a terem médicos veterinários de plantão e coloquem dispositivos de rastreamento nos animais para permitir a localização em tempo real.
Tabata justifica que a medida permitirá possibilitará “uma resposta rápida em casos de emergência, extravio ou qualquer situação que coloque em risco a vida e a integridade dos animais”. Camila propõe tratar o transporte dos animais na cabine como um direito dos tutores, enquanto Tavares quer regras mais rígidas para garantir que os animais tenham acesso à água e à comida e sejam transportados em contêineres seguros e confortáveis.
A proposta mais antiga em tramitação sobre o tema é da ex-deputada Marina Santos (Solidariedade-PI). O relator do texto, Célio Studart (PV-CE), emitiu seu parecer favorável em 5 de julho de 2021, mas o texto nunca foi votado na Comissão de Meio Ambiente.
Há pelo menos outras 16 propostas semelhantes com diferenças quanto ao peso e ao número de animais permitidos por voo, ou versando sobre outras regras, como a exigência de médicos veterinários e supervisão humana durante todo o traslado.
Na quarta-feira, 24, 15 deputados pediram tramitação de urgência para o projeto do ex-deputado Paulo Bengtson (PTB-PA), ao qual a proposta de Marina Santos está apensada (ou seja, tramitando em conjunto). Se o regime de urgência for aprovado, a tramitação é acelerada e o projeto pode ser incluído na pauta do plenário mesmo sem passar anteriormente por todas as comissões.
Apresentado em 2020, o texto originalmente tratava exclusivamente sobre regras para o transporte de animais de assistência emocional ou de serviço, como cães-guia, e também estava na Comissão de Meio Ambiente. Dois dias depois, o relator Delegado Matheus Laiola (União-PR) apresentou um substitutivo.
A deputada federal Rosana Valle (PL-SP), que também apresentou projeto sobre o assunto em 2022, afirma que não deveria haver limite de peso. “Já passou da hora de as empresas aéreas permitirem que nossos animais viagem ao nosso lado, independentemente do tamanho. Eles são parte de nossa família. Não são cargas. O que aconteceu com o Joca, dias atrás, é irreparável, sendo que poderia ter sido evitado”, disse a parlamentar.
