O Supremo Tribunal Federal (STF) tem placar de 3 votos a 0 para manter a decisão individual do ministro Cristiano Zanin que derrubou a desoneração de impostos sobre a folha de pagamento de 17 setores da economia e de determinados municípios até 2027.
A decisão foi proferida nessa quinta-feira (25) e motivada por uma ação protocolada pela Advocacia-Geral da União (AGU).
Até o momento, além de Zanin, os ministros Flávio Dino e Gilmar Mendes também votaram no plenário virtual da Corte pela suspensão da desoneração. A sessão eletrônica vai até 6 de maio.
Na ação protocolada no STF, a AGU sustentou que a desoneração foi prorrogada até 2027 pelo Congresso sem estabelecer o impacto financeiro da renúncia fiscal. A petição foi assinada pelo presidente Luiz Inácio Lula da Silva e pelo advogado-geral da União (AGU), Jorge Messias.
A ação também contestou a decisão do presidente do Senado, Rodrigo Pacheco (PSD-MG), que invalidou o trecho da Medida Provisória (MP) 1.202/2023. A MP derrubou a desoneração previdenciária para pequenas e médias prefeituras.
Ao aceitar os argumentos da AGU, o ministro Cristiano Zanin entendeu que a aprovação de desoneração pelo Congresso não indicou o impacto financeiro nas contas públicas.
“O quadro fático apresentado, inclusive com a edição de subsequentes medidas provisórias com o objetivo de reduzir o desequilíbrio das contas públicas indicam, neste juízo preliminar, que há urgência em se evitar verdadeiro desajuste fiscal de proporções bilionárias e de difícil saneamento caso o controle venha a ser feito apenas ao final do julgamento de mérito”, justificou Zanin.
A desoneração da folha de pagamento para 17 setores e municípios com até 156 mil habitantes foi aprovada pelo Congresso, no entanto, o projeto de lei foi vetado pelo presidente Lula. Em seguida, o Congresso derrubou o veto.
Na manhã de hoje, o presidente do Senado anunciou que a Casa vai recorrer ainda nesta sexta-feira da decisão de Zanin.
